New York Appeals Court Affirms $6 Medical Malpractice Verdict

Marin v. New York City Health and Hospitals Corporation, 105616/06
The First Department has affirmed a $6 million jury verdict from a 2014 medical malpractice case. The jury in the lower court had awarded the amount for both past and future pain and suffering, after determining that his physician had failed to take all necessary measures prior to amputating his leg. The plaintiff’s injuries arose after he was struck by a car while walking in Harlem in 2004. The First Department found that the verdict was supported by legally sufficient evidence.
