Rule Issued by Federal Agency Prevents Nursing Home Arbitration

A federal agency, the Centers for Medicare and Medicaid Services, has issued a ruling forbidding federally funded nursing homes from enforcing forced arbitration clauses in their contracts. The new rule will allow 1.5 million nursing home residents to recover their right to legal action, and is intended to improve disclosure. It is scheduled to take effect in November 2016.
