Caution! Credit Card Fraud Suspects-What to do?

If you notice a credit card fraud suspects or a charge on your credit card transaction history that does not look familiar, it could be credit card fraud. This type of consumer fraud happens when someone makes a purchase or withdrawal or otherwise uses your credit card information without your permission. It can also involve applying for credit cards using your personal information, or any other unauthorized use of your credit.

If you suspect you are the victim of this type of offense, seek help from a credit card fraud attorney in New Jersey as soon as possible.

Call Your Credit Card Company ASAP

If you see fraudulent charges on your existing card, don’t panic. The first thing you need to do is call your credit card issuer (Capital One, American Express, Discover, etc.). To report fraud, there is usually an option that will take you straight through the process (remember this fraud costs your credit card issuer money, so they don’t make it too difficult to report unauthorized charges).

Your credit card company will immediately deactivate the card to prevent further fraudulent charges and should refund you the charges. All the major credit card issuers have a “zero liability” policy in cases such as these, meaning you are not responsible for any of the fraudulent charges.

Make a Police Report if You Have a Credit Card Fraud Suspects

It is prudent to make a police report if you notice multiple transactions quickly and/or high-ticket purchases. By notifying the police, you are creating a record of what happened, and you may help them solve a much bigger case, such as an identity theft ring or counterfeiting operation. If authorities catch the fraudsters, a conviction can help if you need to file a civil claim to recover for losses.

Know Your Rights Under the Fair Credit Billing Act

The Fair Credit Billing Act, passed into federal law in 1974, protects consumers from shady billing practices and things like credit card fraud. The FCBA gives us the right to dispute unauthorized charges, for example. One of the laws established under this act states that you can’t be held liable for more than $50 in fraudulent charges on your card.

Identity Credit Card Fraud Theft

If you feel you may also be the victim of identity theft as well, notify the credit card bureaus immediately. This can protect your credit if the criminals try to open more accounts in your name. Identity theft should also be reported to the Federal Trade Commission.
